The class action lawsuit was filed on February 15, 2006, and is captioned TRACIE L. QUINTERRO; ERIC W. QUINTERRO; LADYBETH PANUSIS; CHARLES PANUSIS; RAUL GARCIA; BRENDA GARCIA; STEPHEN INFERRERA; SHEILA INFERRERA; ANNA NAVARRO; ALONZO COLLINS; LAURA COLLINS; RONALD CARROLL; DORENE CARROLL; SUSAN SHELDON; and ROBERT DOSTLER, all individuals and as Plaintiff Class Representatives v. IPEX USA, LLC, a Delaware Corporation; IPEX, INC., a Foreign Corporation; CLASSIC PLUMBING, INC., a Nevada Corporation; SHARP PLUMBING, INC., a Nevada Corporation; COX & SONS PLUMBING, INC., a Nevada Corporation; DOES I-X; and ROE CORPORATIONS XI-XX, Case No. A517493*. This class action alleges that Kitec® Fittings disintegrate and fail when they are exposed to water because of a well-known chemical reaction called dezincification. As soon as Kitec® Fittings are exposed to water, the brass in the fitting corrodes, which inevitably leaks, reduces water flow, and breaks. Kitec® Fittings therefore not only cause substantial damage after they burst and leak, but also impair the ability of a home's plumbing system to effectively provide water to appliances and plumbing fixtures.
