website has been established by Class Counsel to provide information
to class members of the class action lawsuit involving brass
KITEC® plumbing fittings ("Kitec® Fittings")
that was certified by the Nevada District Court on October 16,
2006, which alleges that KITEC® Fittings are defective because
they dezincify and fail when exposed to water.
This class action includes all owners of residences in Clark
County, Nevada that contain, or at any time contained, a Kitec
and/or PlumBetter piping system and/or components, although
it is now believed this product was not used extensively in
Clark County beyond 2004.
IMPORTANT CASE UPDATES
Extension Of All Kitec Claim Deadlines - Limited Funds
On February 26, 2014, the Court extended all deadlines for owners of Clark County homes that
contain Kitec plumbing systems to file claims requesting the available settlement relief.
The Court extended the deadlines by three (3) years or until the limited funds are exhausted.
The Court also opened up the settlement relief program to individuals who were previously barred
either because they failed to act before the applicable deadline, their home was not included in
the original Kitec fittings litigation, or they previously opted out of this class action.
During the week ending March 28, 2014, the claims administrator mailed
along with a claim form to over 6,250 potential class members.
will appear in the Nevada Section of the Las Vegas Review-Journal on Sunday, March 30, 2014 and the following
three Mondays: April 7, 14 and 21, 2014.
Additionally this letter
will be mailed to over 150 licensed plumbing contractors operating in Clark County for information purposes.
Funds for this relief program are limited and claims will be handled on a first-come,
first-served basis. Class members must ACT NOW or risk being permanently barred from receiving any
relief related to the defective Kitec fittings installed in their homes.
Court Approves Additional Benefits & Extends Deadlines
On October 29, 2012, the claims administrator mailed this notice to thousands of class members to inform them that full replumbs at no cost are now available to them and their deadline to claim relief has been extended to January 29, 2013. The notice applies to Kitec homeowners in the following subclasses: (1) Woodside Homes Subclasses A-B, (2) Kimball Hill Homes Subclass A, (3) Champion Homes Subclasses A-C, (4) Vipor Homes Subclasses A-B, (5) the Santa Fe Homes Subclass, and (6) several other small groups of class homes. For more information, please contact the claims administrator by the methods described in the notice.
Court Approves Additional Benefits
On June 11, 2012, the Court ordered that unclaimed settlement funds from some subclasses be used to benefit other
Kitec class members. The additional funds will benefit the homeowners who are required to pay for a portion of
their replumbs. The Court's order means that these homeowners are now entitled to $915.70 per home in additional
funds for their replumbs. Depending on individual circumstances, this increase may result in some homeowners
receiving replumbs at no cost to them. The Court's order benefits homeowners in the following subclasses: (1)
Woodside Homes Subclasses A-B, (2) Kimball Hill Homes Subclass A, (3) Champion Homes Subclasses A-C, (4) Vipor Homes
Subclasses A-B, (5) the Santa Fe Homes Subclass, and (6) several other small groups of class homes. On July 1, 2012,
the claims administrator sent out this letter
to thousands of homeowners impacted by this increase in settlement benefits.
